DASHING DIVAS RIDESHARING

CHARGES  

As a Scheduler, you understand and agree that your request or use of the Dashing Divas Online Platform may result in charges to you (“Charges”). Charges include all applicable fees, plus any tips to the Tending Driver that you elect to pay. Dashing Divas has the authority and reserves the right to determine and modify pricing by posting applicable pricing terms to our market’s pricing page or quoting you a price for a specific ride at the time you make a request. You are responsible for reviewing the applicable pricing terms and shall be responsible for all Charges incurred.

FEES AND OTHER CHARGES  

Tending Drivers Fees. The “Tending Driver Fees” consists of a Base Fare, Booking Fee, local operating costs (as applicable). For short rides, minimum fares may apply.   You will see a fare estimate on our site upon scheduling the ride. While ride pricing is fixed based on the estimated time and distance at the time of booking. 

WAIT TIMES 

Tending Drivers wait time will be no more than 10 minutes, this may cause them to be late to another scheduled pick-up. The Tending Driver has the right to cancel a pickup if it's over 10 minutes of wait time. Scheduler will be responsible for the cost of a $15 cancellation fee by Tending Driver if wait time exceeds 15 minutes or more.

REFERRAL FEES

Schedulers and Tending Drivers are welcome to make a driver and/or rider referrals to Dashing Divas at any time. However, these referrals must use our services for 90 days without incident before a referral fee is issued. 

CANCELLATION FEES

Scheduler: After requesting your ride, you may cancel it up to 48 hours before your ride with no “Cancellation Fee.” A cancellation fee of 50% is required for cancellation request made within 24 hours before picking up.  If you cancel less than 8 hours before your ride, you will be charged 75% of the fee.  Any remaining fees may be refunded or used as a credit for your next ride.

Tending Driver: After requesting your ride, a Tending Driver can cancel within 48 hours before picking up, allowing us time to find another suitable replacement. If for any reason they cancel 24 hours or less, and we are unable to find a suitable replacement for your ride, Dashing Divas will offer a full refund of the fee, or you may use it as a credit for your next ride. 

DAMAGE FEE

If a Tending Driver reports damage to, or necessary cleaning of, vehicles or property as a result of providing Services to you or to a rider on whose behalf you arranged a ride, you agree to pay a Damage Fee. The Damage Fee will be an amount that Dashing Divas determines, in its sole discretion, is reasonable depending on the extent of the damages and cost of repairing or cleaning the vehicle. Dashing Divas reserves the right, but is not obligated to, verify or otherwise require documentation of damages prior to processing the Damages Fee.  

TOLLS

In some instances, tolls (or return tolls) may apply to your ride if utilizing Distance Destinations for travel. We will use market’s pricing information to calculate toll charges and a list of applicable tolls and return charges. Scheduler may be responsible for these additional fees.

LOST ITEMS

From time to time, riders leave behind personal items in Tending Drivers’ vehicles. Dashing Divas will make an attempt to facilitate the return of your lost items. Items can be held and returned to the rider on the next available trip or within 72 hours.  Lost or misplaced items by the rider are not the sole responsibility of the Tending Driver or Dashing Divas.

TIPS 

Dashing Divas does not currently offer an online feature to facilitate tips to Tending Drivers, but Schedulers are free to make other arrangements to provide tips to Tending Drivers if they so choose. 100% of all tips will go to the Tending Driver.  

PROCESSING OF PAYMENTS 

Payments shall currently only be made through the Dashing Divas Online Appointment Platform. All payments will be processed by a third-party payment processing service and applied to the credit card, debit card and/or checking account. You must provide and maintain complete and accurate information about your payment method. You are responsible for any additional fees, charges, or penalties resulting from any failure to pay. Your full payment to Dashing Divas satisfies your payment obligation for your appointment. Dashing Divas reserves the right to suspend or refuse service for failure to pay any payment due.  Dashing Divas is not responsible for any fees or charges, including overdraft charges, that may be issued by the bank issuing your debit card, credit card, or check account and we are unable to assist you in recovering them from your issuing bank.  Where the fees are being customized due to an Account Credit, Dashing Divas will deduct the amount due first from the Account Credit. If the Schedulers Account Credit is not sufficient to cover the fees, Dashing Divas will first deduct the available Account Credit and then adjust the remaining amount for the Scheduler to pay.  

REFUNDS

Some payments are non-refundable. Please see "CANCELLATION FEES" for details. 

ACCOUNT CREDITS 

You may receive an Account Credit that you can apply toward payment of certain fees upon completion of a ride. If the fees for a single ride are less than the maximum value of the trip credit, the difference will be forfeited. If the fees exceed the value of the trip credit, you agree to pay the difference via a customized quote. Account Credits are only valid for use on the Dashing Diva Online Platform and are not transferable or redeemable for cash except as required by law. Account Credits cannot be combined. If you split payment for a ride with another Scheduler, your Account Credit will only apply to your portion of the fees. Additional restrictions on Account Credits may apply as communicated to you in a relevant credit or promotion.  

TENDING DRIVER PAYMENTS 

If you are a Tending Driver, you are entitled to a “Driver Fee” for the Services you provide or perform for Schedulers.  The Driver Fee consists of an applicable base fare, depending on your trip services, for first five miles and/or actual time after the first 30 minutes. Dashing Divas will calculate and determine a set Driver Fee on your behalf after each ride. Driver Fees may vary from the fee or other charges due and collected from Schedulers.  Additional Payments. In addition to the Driver Fee, you may receive the following payments, if applicable: (i) any tips provided by a Scheduler to you, (ii) any tolls or surcharges we collect for remittance to you, (iii) any damage charges collected on your behalf, or (iv) any incentive payments you earn based on your provision of services. The net amount of any payments you receive will reflect any applicable fees or other charges owed by and collected from you in exchange for your use of the Dashing Divas Online Platform.  

PAYMENT ADJUSTMENT AND RECONCILIATION

Dashing Divas will collect payments owed to you by Schedulers and other third parties as your limited collection agent and you agree that receipt of such payments by Dashing Divas satisfies the payer’s obligation to you. Dashing Divas Rider Fees, or other payment owed to you (except tips) (i) to retain a Cancellation Fee, or any portion thereof, (ii) if we believe you have attempted to defraud Schedulers, Dashing Divas, or Dashing Divas appointment or payment systems, or (iii) in order to resolve a Scheduler complaint (e.g., that you took an inefficient route or failed to properly report when the ride was over). Dashing Divas reserves the right to adjust or withhold Ride Fees or other payments in a reasonable manner. You agree that all payments owed to you shall not include interest and will be net of any amounts that are required to withhold by law.  

PROCESSING PAYMENTS 

Payment processing for Tending Driver is provided by PayPal, Zelle, CashApp or ???? and are subject to their account agreements and fees, which includes their Terms of Service. By agreeing to the Terms or continuing to use the Services, you agree to be bound by their Services Agreement, as the same may be modified by these companies from time to time. As a condition of Dashing Divas enabling payment processing services through these companies, you agree to provide Dashing Divas accurate and complete information about you, and you authorize Dashing Divas to share it with these companies, along with the transaction information related to your use of the payment processing services provided by these companies.  

TAXES

Tending Drivers are responsible for reporting to all applicable government agencies as income all payments received. Dashing Divas will report by a third-party payment processor the payments paid to Tending Drivers under this Agreement by filing Form 1099-MISC with the Internal Revenue Service as required by law. You will be solely responsible for payment of all withholding taxes, social security, workers’ compensation, unemployment and disability insurance or similar items required by any government agency for any payments received by you. Tending Drivers will comply with all applicable federal, state, local, and foreign laws governing self-employed individuals, including laws requiring the payment of taxes, such as income and employment taxes, and social security, disability and other contributions.  

ADDITIONAL PAYMENTS

Tending Drivers acknowledge and agree that, for the mutual benefit of the parties, through advertising and marketing, Dashing Divas may seek to generate additional demand for Tending Drivers to seek new and existing customers by using signage on their vehicles. Such advertising or marketing (i.e., through signage) does not entitle Tending Drivers to any additional monetary amounts beyond the amounts expressly set forth in their Payment Terms. These advertisements or offers to participate in a promotion, unless made to you, are inapplicable to these terms or your relationship with Dashing Divas.  However, Dashing Divas will offer an incentive for customer or driver referrals. 

PROMOTIONS  

Dashing Divas, in its sole discretion, may offer promotions with different features and terms to any of its Schedulers. These promotions or offers to participate in a promotion, unless made to you, are inapplicable to these Pricing and Payment Terms or your relationship with Dashing Divas. Discounts to Schedulers will not impact the fees or any other payments owed to Tending Drivers. You agree that Dashing Divas may generate additional leads for your services on your behalf.    

ENGAGED TIME

All rides on this Online Platform are prearranged for our Tending Drivers.  Engaged Time is the period of time from when the Tending Driver accepts a ride request to when the Tending Drivers drops off the rider(s) and confirms the drop off through the identified application.  While a Tending Driver may claim a ride week in advance of the ride start time, a Tending Driver accepts a ride request once the Tending Drivers departs for the pick-up location, indicates in the application, “Check In,” and is within the metro area acceptance radius of the pick-up location. Engaged time does not include time spent on any personal activities, including but not limited to stops unrelated to the services.  ENGAGED TIME EXCLUDES ANY TIME SPENT PERFORMING THE SERVICES AFTER THE SERVICE REQUEST HAS BEEN CANCELLED; THE TENDING DRIVER HAS BEEN REMOVED FROM A RIDE DUE TO EXTREME LATENESS (15 or more minutes late to the scheduled pick-up) OR OTHER INABILITY TO PERFORM THE SERVICES AT THE FAULT OF THE TENDING DRIVER; ANY TIME SPENT ON A SERVICE WHERE THE TENDING DRIVER ABANDONS PERFORMANCE OF THE SERVICE PRIOR TO COMPLETION; OR ANY FRAUDULENT USE OF THE IDENTIFIED APPLICATION OR ONLINE PLATFORM.   

SCHEDULER TERMINATION

Dashing Divas reserves the right to terminate services for any reason deemed necessary. Including, but not limited to: INCOMPLETE OR DECLINED PAYMENTS, ASSESSIVE WAIT TIMES AND CANCELLATIONS, UNRULY OR DISRESPECTFUL BEHAVIORS BY RIDERS, NOT FOLLOWING ANY POLICIES OR PROCEDURES SET FORTH BY DASHING DIVAS.

TENDING DRIVER TERMINATION

Your service with Dashing Divas is a 1099 contracted service. We will closely adhere to Maryland labor laws including at-will employment laws and any and all EEOC discrimination laws.

DISCLOSURE

All written and oral information & material provided by Dashing Divas to the Tending Driver in addition to other valuable information regardless of whether the information is disclosed before or after hire is consider confidential. This includes and is not limited to all, BUSINESS OPERATIONS, CUSTOMER INFORMATION, INTELLECTUAL PROPERTY, PRODUCT INFORMATION, SERVICE INFORMATION, PRODUCTION PROCESSES, ACCOUNTING INFORMATION, MARKETING & DEVELOPMENT INFORMATION, COMPUTER TECHNOLOGY, PROPRITORY COMPUTER CODES & PASSWORDS, AND ANY THIRD-PARTY INFORMATION.
